Terms of Service

The agreement for creating, refining and sharing your house with my3dhouse. Please read it before uploading references or placing an order.

1. Who you are buying from

my3dhouse is operated by Marcus Greenwood trading as my3dhouse, an individual sole trader, at Leigh Park Road, Leigh-on-Sea, SS9 2DU, United Kingdom. Contact mg3d@ub.io for questions, support, complaints or cancellation requests.

These terms cover the website, iPhone and iPad app, rendering, edits and house hosting. By submitting a house or placing an order, you agree to these terms. You must be at least 18 and able to enter into a contract to create a house or make a purchase. If acting for someone else, you must have their authority.

Our Privacy Policy explains how information is handled. For an app obtained through the App Store, Apple’s Standard End User Licence Agreement also governs the app licence. These terms govern the my3dhouse service and do not remove rights under applicable consumer law.

2. What we provide

We use your photos, plans and instructions to create an interactive 3D visualisation that you can explore, request edits to and choose to publish. The work uses AI through OpenAI’s cloud services and Blender on an external rendering server.

A model is an interpretation of the references. Dimensions, hidden elevations, materials and surroundings may be inferred or inaccurate. It is not a measured survey, architectural design, construction document, structural assessment or evidence of planning compliance. Do not rely on it for building work, safety decisions or other purposes requiring a qualified professional.

More clear references usually help. We cannot guarantee an exact replica, a particular artistic result or that every detail will be visible. The famous-house examples are illustrative studies; they do not imply endorsement by an architect, owner or associated organisation.

Models are supplied through an interactive viewer. You need internet access and a supported modern browser with WebGL, or the compatible iOS app. Device performance may affect large models. The service does not include delivery of editable Blender files or a model download unless separately agreed.

3. Your references and permissions

Only submit material you have the right to use for this purpose and permission to send to our providers. Owning a property does not necessarily give you copyright in an architect’s plans or a photographer’s images. Obtain the necessary permission before uploading.

You retain your rights in your uploads. You give us a limited, non-exclusive licence to store, copy, convert and use them, and to have our service providers process them, as needed to create, edit, support and host your house. If you publish, this also permits us to display your chosen public model, name, description and rendered preview. We do not take ownership of your reference material.

As between you and us, you may use the generated house to the extent permitted by applicable law and any rights in the source material. AI output may not be unique or eligible for copyright protection. We cannot grant rights belonging to another person.

Do not upload unlawful or infringing material, unnecessary personal or sensitive information about other people, malicious files or instructions intended to bypass the service’s protections. Do not use the service to harass people, expose private information or interfere with other users’ houses.

4. Prices, payments and edit credits

On the website, a first render costs £5 and includes five edits. A further five edits cost £2.50. Valid promotional codes can reduce the amount due. A zero-total order requires no card payment. The final total, including any applicable tax, is shown before you confirm your order. These are one-off purchases, not a recurring subscription.

Stripe processes web payments. Where purchases are available in the iOS app, Apple processes them as in-app purchases at the local price shown in the App Store payment confirmation; that price may differ from the website. App Store purchases are subject to Apple’s payment terms. A purchase is only fulfilled after payment, or a zero-total order, is verified.

Each submitted edit request uses one credit, even if it contains several requested changes. Credits belong to that house and cannot be pooled between houses or exchanged for cash, except where a refund is required by law. Credits do not have a scheduled expiry while the service remains available.

A failed initial build can be retried without another render charge. If an edit fails, its credit is returned. A disappointing result is not automatically classified as a technical failure; contact us if something is wrong so we can review it. This does not limit your rights to a remedy for a service that does not meet the contract.

5. Build times and availability

Countdowns and progress messages are estimates, not guaranteed delivery times. Complexity, the queue, provider availability and rendering server availability can affect timing. Drafts shown during a build are unfinished. We will make the completed model available in your library and send a completion email if notifications are enabled.

We aim to provide the service with reasonable care and skill. If we cannot fulfil a paid order, we will discuss a remedy, which may include a retry or refund. We may pause the service for maintenance or security, and will give reasonable notice of material planned changes where practical.

6. Cancellation, problems and refunds

If you are a UK consumer buying at a distance, you normally have 14 days from making the contract to notify us that you wish to cancel, subject to the rules applying to services and digital content. We do not treat a render starting, or acceptance of these terms alone, as an automatic waiver of a statutory cancellation right.

To cancel or report a problem, email mg3d@ub.io with your order date, house name or address, and order reference if available. Any clear statement that you wish to cancel is sufficient. You may use: “I wish to cancel my my3dhouse order placed on [date], order reference [reference]. My name is [name] and my contact address is [address].” You do not have to use this wording.

Where the law allows a charge for work already supplied before cancellation, it must be based on the required advance information and your valid request or consent. We will not rely on a consent or acknowledgement we have not actually obtained. If a refund is due, we will return it through the original payment method within the time required by law, normally within 14 days of the relevant cancellation notice.

For App Store charges, you can request a refund through Apple. Apple handles those payment refunds under its terms and applicable law. You can still contact us about the service or your consumer rights.

Your statutory rights are unaffected, including applicable rights to reasonable care and skill, digital content of satisfactory quality and as described, repeat performance, repair or replacement, a price reduction or refund. Using edit credits is not your only remedy for a breach of those rights.

7. Keeping access to your house

Your library uses a credential saved in your browser or app. There is no conventional password account or automatic cross-device library sync. The iOS and web libraries are separate. Clearing site data, uninstalling the app or losing the device can remove owner access, so keep the relevant app or browser data.

A completion email link allows anyone who has it to view the completed version for 30 days. It cannot edit a house or restore a lost library. Keep private links private. Contact us if you lose access; recovery may depend on whether we can safely verify ownership, and is not guaranteed.

8. Publishing and hosting

Publishing is your choice. Review the model, title and description before publishing. A public house can be viewed, indexed and shared by others, including through social preview images. Your uploaded reference photos and plans are not displayed on the public page.

House addresses are allocated from available names and may receive a numeric suffix. An address is not a separately owned domain or a promise of permanent hosting. We provide hosting as part of the service while it is available, with no separate recurring charge at present. If we plan to withdraw hosting or materially change it, we will give reasonable notice where possible and address outstanding paid obligations.

Edits do not change an existing public snapshot until you republish. To ask us to unpublish a house, remove your data or address someone else’s use of your material, contact mg3d@ub.io. We may verify the request. Removing our copy cannot remove copies or previews retained by third parties.

9. Fair use and service changes

We may restrict a submission or access where reasonably necessary to stop unlawful content, infringement, fraud, abuse or a security threat. We will explain and allow you to contact us where lawful and practical. Restrictions do not automatically forfeit prepaid rights or remove a refund that is legally due.

We may update these terms for future use and show a new effective date. The terms applicable to an existing order continue to govern that order unless a change is required by law or you agree to it. Material changes will be brought to your attention appropriately.

10. Responsibility and applicable law

We are responsible for loss or damage that is a foreseeable result of our breach of these terms or failure to use reasonable care and skill. The service is intended for personal visualisation; we do not accept responsibility for business losses where you use it commercially. You remain responsible for how you choose to use or share a model and for obtaining professional advice where needed.

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for fraud, death or personal injury caused by negligence, or your mandatory consumer rights. We do not require you to indemnify us for all claims or agree to compulsory arbitration.

These terms are governed by the law of England and Wales. If you are a consumer, you also retain mandatory protections and any right to bring proceedings in the courts of the place where you live. Please contact mg3d@ub.io first if you would like us to try to resolve a concern; doing so is not a condition of exercising your legal rights.
